1. THIS IS A LEGAL AGREEMENT. BY JOINING YOU ARE AFFIRMATIVELY STATING THAT YOU HAVE READ AND UNDERSTAND THE TERMS AND CONDITIONS SET FORTH HEREIN AND ARE AFFIRMATIVELY INDICATING YOUR ACCEPTANCE OF THIS AFFILIATE PROGRAM AGREEMENT AND THAT YOU AGREE TO BE BOUND BY THE TERMS HEREOF. YOU CANNOT BECOME A MEMBER OF THE AFFILIATE PROGRAM UNLESS YOU HAVE ACCEPTED EACH AND EVERY TERM HEREOF.
2. BentBucks reserve the right to change any of the terms and conditions at any time. This includes the payout rates and schedule.
3. The BentBucks program is available to webmasters with adult traffic only. Those without an adult website may not participate.
4. To keep your account active, you must send traffic, if you don't send any hits in a 90-day period or your email address is invalid you will be deactivated. Basically just use the account and send traffic. That is how you make money. We WILL do everything in our power to make you money.
5. We do not allow our banners or advertisements to be used on sites with links or banners to, references of, or content of child porn, bestiality, rape, torture, molestation, celebrities, incest, or other illegal forms of content. Webmasters found using BentBucks banners or advertisements on sites with this content will have their account terminated without payment and the proper authorities notified. (MAKE NO MISTAKE ABOUT THIS ONE)
6. Webmasters shall not alter the BentBucks banners in any way. Webmaster may use or create other banners and advertisements to promote BentBucks affiliate sites provided that all content used to produce such banners is licensed to the creator.
7. Text links to BentBucks sites are allowed.
8. BentBucks retains all copyright and ownership of the banners and ads provided, including all images therein.
9. You may NOT hot link any of our banners from our server, if you do, you WILL be cancelled without payment.
10. Webmasters shall remove banners or advertisements immediately on request or upon termination from the BentBucks affiliate Program.
11. Any violations of the BentBucks policies or our Webmaster agreement are grounds for deletion from the program and as such you agree to forfeit all commissions earned.
12. We do not tolerate cheats - we will not pay cheats.
13. NO SPAM. SPAM SUCKS. I hate getting it, you hate getting it, and our customers hate getting it. DO NOT USE IT. This includes [but is not limited to] Unsolicited emails, instant messages, newsgroups and chat room messages. If you SPAM we WILL hear about it and you will be summarily removed from the program for life.
14. In cases of disagreement, our third party billers' files and stats will prevail.
15. Due to rampant abuse we will not accept Webmasters from Albania, Armenia, Azerbaijan, Belarus, Brazil, Bulgaria, China, Costa Rica, Croatia, Czech Republic, Estonia, Georgia, Hungary, India, Indonesia, Israel, Japan, Jordan, Kaliningrad, Kazakhstan, Korea (North and South), Kyrgyzstan, Latvia, Lithuania, Malaysia, Moldova, Pakistan, Philippines, Romania, Russia, Singapore, Slovakia, Slovenia, Syria, Taiwan, Tajikistan, Thailand, Turkey, Turkmenistan, Ukraine, United Arab Emirates, Uzbekistan, and Yugoslavia. If you feel you are an acceptation to the rule, do feel free to email us with references.
Note: We are looking for honest hard working webmasters to make lifetime business partnerships with, and are more than willing to work with you. Please if there is something you even feel a little bit weary about doing with our programs, send us some mail first and get written permission from us.
:: webmaster agreement ::
1. The following must be agreed to in order to participate in our Partnership Program. All Program Terms and Conditions must be abided by, and are legally binding.
2. BentBucks may modify any of the statements contained in this Agreement, at any time and in our sole discretion. Notice of any change by e-mail sent to your address on our records, or the posting on our site of a change notice of a new agreement, is considered sufficient notice for notifying you of a modification to the terms and conditions of this Agreement. Modifications may include, but are not limited to, changes to commission schedules, payment procedures, and Affiliate Program Terms and Conditions and Webmaster Agreement. All such modifications shall take effect 48 hours after we serve notice as provided above, unless we indicate otherwise. If any modification is unacceptable to you, your only recourse is to terminate this Agreement. Your continued participation in the Affiliate Program, following our posting of a change notice or new agreement on our site, will constitute binding acceptance of the change.
3. BentBucks shall provide Webmaster suitable banner advertisements for Webmasters use.
4. BentBucks retains all copyright and ownership of the banners and ads provided, including all images therein.
5. During the existence of this agreement, BentBucks hereby grants to you the right to use banners and ads provided by BentBucks on your web page, solely to generate memberships to BentBucks affiliate sites.
6. Upon any termination of your participation in this Webmaster Program, all granted rights shall cease and you must immediately remove all Bent Bucks banners and ads from your web pages.
7. If we notice any signs of fraud on your account, we reserve the right to put your account "on hold". When your account is on hold there will be no more checks issued until we have resolved the issue. If it was a mistake on our part, there will be NO LOSS OF INCOME. Webmaster will not be paid commission on any fraudulent transactions, or when fraud is suspected. Fraud will be prosecuted to the full extent of the law.
8. Webmaster must be of legal age in their jurisdiction of any municipality, city, state, country, or other governmental entity to view adult content to participate in Bent Bucks affiliate program
9. Webmasters are solely responsible for all content on their own Internet web site. Webmaster acknowledges that BentBucks does not actively monitor the content of Webmaster's site and as such BentBucks assumes no responsibility for the content of any Webmaster's site.
10. Webmaster agrees to utilize only legal images and content that is licensed to Webmaster. Webmaster shall refrain from displaying or using any content that infringes upon the copyright, patent, or right of another person or entity.
11. Webmaster will refrain from content of or any reference to child pornography, bestiality, rape, torture, celebrities, or any other illegal forms of content. If BentBucks is informed by competent authority that Webmaster is in violation of state or federal laws regarding content on Webmaster's site, Webmaster will be removed from the BentBucks system, and all commissions owed to Webmaster will be forfeited. Use of illegal content by Webmaster constitutes a material breach of this contract.
12. BentBucks reserves the right to refuse services to any Webmaster at any time for any reason.
13. BentBucks reserve the right to deny any prospective Webmaster admittance into our program for any reason, based on the content of their web site or for any other reason.
14. Webmaster agrees to indemnify, defend and hold harmless Bent Bucks from any claims arising out of the use of its services, including but not limited to, prosecution under any pornography, obscenity, copyright or licensing laws of the United States or any state, civil litigation, administrative action, arbitration or mediation. This indemnification includes an obligation for Webmaster to reimburse Bent Bucks for any costs, fees or expenses that BentBucks may incur as a result of any such claims.
15. The rights of Webmaster under this agreement are not transferable.
16. This agreement may, at the sole discretion of BentBucks, be amended. Webmaster agrees to abide by any amendments to this agreement. Webmaster agrees to review this agreement periodically for amendments.
17. This agreement shall exist indefinitely from the date of acceptance until cancelled by either party. BentBucks and Webmaster reserve the right to cancel this agreement at any time.
18. Webmaster agrees to use the BentBucks system at its own risk. BentBucks provides no warranty in regards to this agreement. Any liability by BentBucks for loss of revenue, data, or time through, but not limited to, any action, error, omission, deletion, or delay of service by BentBucks, is expressly disclaimed.
BENT BUCKS NO SPAM POLICY
Under no circumstance should anyone participating in the bentbucks webmaster program send email or post notices of any kind through email, newsgroups, IRC posts, and/or instant messaging clients promoting our services. Unless prior permission and admission to EMAIL APPROVED WEBMASTER LIST is granted in writing by the bentbucks webmaster program.
ANY violation of this NO SPAM policy will result in immediate termination of your bentbucks account.
EMAIL APPROVED WEBMASTER LIST
Webmasters with legitimate opt-in e-mail lists may apply to bentbucks to become email - approved.
Webmasters who are on our email - approved list must follow all guidelines listed under BENT BUCKS E-Mail CONTENT POLICY and the CAN-SPAM Act of 2003 before you can send any email promoting any site associated with the bentbucks program.
BENT BUCKS E-mail CONTENT POLICY
Email Header [Brown Paper Wrapper]
The email header must contain the label “SEXUALLY-EXPLICIT” and must contain accurate information including an originating email address, company name and street address information, domain name, and an automated unsubscribe link. No other information or content should be immediately viewable by the recipient prior to scrolling.
‘From’ Line
The ‘from' line must accurately identify the person who initiated the message, and should not be false or misleading.
Subject Line
Any Email promoting Bent Bucks group of sites must have an "SEXUALLY-EXPLICIT:" warning in the subject line. messages will not be allowed to contain graphic material.
EMail Body
The e-mail body must contain SOFTCORE images ONLY, messages must not contain graphic material.
OPT-IN ONLY
All email addresses must be opt-in only and upon request webmasters must supply bentbucks with the recipients Name email address IP address and physical address (when possible) and the the details of original origin of the collection of the email address.
(a) A recipient must have expressly consented to receiving email – eg; present or past customers
(b) If the email is from a party other than that which they have given prior consent the recipient must have been given clear notice at the time that consent was communicated the recipients email address may be transferred, for the purposes of transmitting commercial e-mail.
Automated OPT-OUT LINK REQUIRED
All mail messages must contain a functioning automated opt-out link, which instantaneously removes the recipient permanently from the email list and guarantees that the recipient will receive no further e-mail.
Requests for removal must occur instantaneously with no exceptions.
Violations of the BENT BUCKS NO SPAM POLICY or BENT BUCKS E-mail CONTENT POLICY or the CAN-SPAM Act of 2003 will result in immediate termination of your bentbucks account and all moneys earned will be subsequently lost.
